We publish property information to help you make decisions, but availability and prices change. Sales are only binding when a written agreement is signed by buyer and seller. Always verify title and pay only into verified accounts. We protect your data per our Privacy Policy. Ghana law applies.
1) Who we are
Vista’O Real Estate (“Vista’O,” “we,” “our,” or “us”) operates the website https://vistaorealestate.com (the “Site”) and provides real-estate marketing, buyer representation, due-diligence facilitation, property consultancy, construction coordination, interior décor, and related services (collectively, the “Services”).

2) Acceptance of these Terms
By accessing the Site, creating an account, submitting an enquiry, booking a viewing, or engaging our Services, you agree to these Terms & Conditions (“Terms”) and to our Privacy Policy and any service-specific agreements we present to you (e.g., agency agreements, commission MOUs). If you do not agree, please do not use the Site or Services.
3) Definitions

Client/You: A person or entity using the Site or Services.

Listing: A property, land, or project/estate displayed on the Site or shared by Vista’O via email/WhatsApp.

Seller/Developer: Third parties offering properties displayed by Vista’O.

Transaction: Any sale, purchase, lease, or option relating to a Listing.
4) Informational Purpose & No Warranty
Listings, prices, floor areas, plot sizes, photos, videos, virtual tours, maps, and descriptions are provided for general information only and may change without notice. While we aim for accuracy, we do not warrant that content is complete, current, free from errors, or suitable for your purposes. You must conduct your own checks and obtain independent legal/technical advice.
5) No Offer; When a Deal Becomes Binding
Nothing on the Site is a binding offer. A Transaction becomes binding only when buyer and seller (or their authorized reps) sign a written Sale & Purchase Agreement (or lease) that sets out the final price, terms, and conditions. Until then, properties may be sold, withdrawn, or repriced.
6) Due Diligence & Title
Vista’O facilitates due diligence (e.g., searches, survey checks, developer vetting) to help you make informed decisions. We are not a law firm and due-diligence assistance is informational support, not legal advice. You are responsible for confirming:

Ownership and encumbrances (site plan/indenture, land title, leases);

Boundaries, zoning, utilities, and access roads;

Fees, taxes, and timelines at public offices (which may vary).
We strongly recommend independent legal review before any payment.
7) Fees, Commissions & Payments

Agency/Professional fees (buyer or seller side) will be disclosed in writing (e.g., an MOU or agency agreement). Typical seller agency commission is [5%] unless otherwise agreed.

Vista’O does not accept client funds in cash. Pay only to named accounts stated in your written agreement or invoice.

Anti-fraud notice: Always verify bank details verbally with a known Vista’O contact before any transfer. We are not liable for payments made to wrong or fraudulent accounts.
8) Pricing, Taxes & Currency
Prices may be quoted in GHS and/or USD. Exchange rates fluctuate. Unless otherwise stated, prices exclude taxes, registration, and professional fees. Any “slightly negotiable” notation is subject to seller approval.
9) Viewings, Proxy Tours & Access
We offer in-person viewings, proxy/family viewings, and virtual tours (video calls, recorded walk-throughs). Access is by appointment and may require ID verification. Site visits to land are subject to weather, access roads, and safety conditions.
10) Projects/Estates & Inventory
For estate/subdivision projects, availability, plot sizes, and pricing can change during sales phases. “Plots remaining” is indicative only. Allocation is confirmed upon a signed agreement and payment as per the project’s allocation policy.
11) Construction & Interior Services
Where we coordinate construction or interior décor (via Sleep Haven or vetted partners), the scope, timelines, quality standards, warranties, and payment schedules will be set out in a separate contract. Variations and lead times depend on material availability and approvals. Vista’O is not liable for delays or defects caused by third-party suppliers or force majeure.
12) Your Responsibilities
You agree to:

Provide accurate information and proof of funds when reasonably requested.

Refrain from unlawful use of the Site; do not scrape, copy, or misrepresent content.

Respect privacy and property rules during viewings/visits.

Not publish our confidential documents, search reports, or proprietary media without written consent.
13) Accounts, Messaging & Communications
If you create an account or contact us via forms/WhatsApp/phone/email, you consent to being contacted regarding your enquiry. You are responsible for safeguarding your login credentials. We may use email, SMS, and WhatsApp for service communications.
14) Intellectual Property
All trademarks, logos, photos, videos, text, layouts, and graphics on the Site are owned by Vista’O or licensed to us. You may not reproduce, distribute, or create derivative works without our written permission. If you believe material infringes your rights, contact us for takedown.
15) User Content & Testimonials
If you submit reviews, testimonials, images, or comments, you grant Vista’O a non-exclusive, royalty-free license to use, display, and edit such content for marketing and service delivery, in line with our Privacy Policy. Do not upload content you do not own or that violates rights or laws.
16) Third-Party Links & Tools
We may link to third-party sites (mortgage providers, banks, developers, maps). We are not responsible for their content, privacy practices, decisions, or performance. Use at your own discretion.
17) Privacy & Cookies
Your use of the Site is also governed by our Privacy Policy and cookie practices (e.g., analytics, chat widgets). By using the Site, you consent to processing as described there.
18) Disclaimers & Limitation of Liability
To the fullest extent permitted by law:

The Site and Services are provided “as is” and “as available.”

We exclude all implied warranties of accuracy, fitness for purpose, and non-infringement.

Vista’O is not liable for indirect or consequential loss (e.g., loss of profit, opportunity, or data), property defects not reasonably discoverable, third-party actions, delays at public offices, or force majeure.

Our total liability in connection with any claim relating to the Site or general Services shall not exceed the fees you paid to Vista’O for the specific service giving rise to the claim.
19) Indemnity
You agree to indemnify and hold Vista’O harmless from claims, losses, liabilities, and expenses arising from your breach of these Terms, misuse of the Site, or violation of laws or third-party rights.
20) Suspension/Termination
We may suspend or terminate access to the Site or Services (with or without notice) if you breach these Terms, misuse the Site, or for security/operational reasons.
21) Changes to Listings, Services, or Terms
We may update the Site, Listings, and these Terms at any time. Changes take effect when posted on the Site with the “Last updated” date. Your continued use after changes means you accept them.
22) Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of Ghana. Disputes shall first be negotiated in good faith; if unresolved within 30 days, the matter may be referred to mediation/arbitration in Accra under applicable Ghana ADR rules, or otherwise to the competent courts in Accra.
